New Delhi: The Delhi High Court has passed a significant order in a case involving actress Aishwarya Rai Bachchan and her daughter, Aaradhya Bachchan, setting a strong legal precedent in India for the “Right of Publicity” and against online defamation. This verdict could prove to be a major step in preventing the misuse of identity in the digital age, not just for celebrities but for ordinary citizens as well.
The case was related to several YouTube channels spreading sensational and fake news about the health of Aaradhya Bachchan, using her images and videos to disseminate false information. Acting on a petition filed by Aishwarya Rai, the court immediately issued an injunction against these channels.
What are ‘Personality Rights’ or the ‘Right of Publicity’?
The ‘Right of Publicity’, also known as Personality Rights, gives an individual the authority to control the commercial use of their identity. This means that no one can use your name, image, voice, or any other aspect of your identity for their own benefit without your permission. While there is no specific law for this in India, the courts have recognized it under the Right to Privacy and Article 21 (Right to Life and Personal Liberty) of the Constitution.
What Did the Court Say?
Justice Tejas Karia, making strong remarks in the case, stated that the unauthorized use of a person’s identity not only causes commercial loss but also harms the individual’s dignity and reputation. The court observed that these YouTube channels were spreading false and disturbing news about a minor child solely for monetary gain, which is completely unacceptable.
The court directed Google and various social media platforms to remove all such objectionable URLs and content within 72 hours.
Not Just Aishwarya, Many Stars Have Raised Their Voice
This is not the first time a celebrity has approached the court to protect their rights.
- Amitabh Bachchan: In 2022, Amitabh Bachchan also sought an injunction from the Delhi High Court against the illegal use of his name, image, and voice, after which the court passed a landmark order.
- Anil Kapoor: Recently, actor Anil Kapoor also received protection from the court against the misuse of his famous dialogue “Jhakaas” and his name.
- Abhishek Bachchan: Following Aishwarya Rai, her husband and actor Abhishek Bachchan has also filed a petition in the Delhi High Court seeking protection for his personality rights.
These cases highlight the growing concern among celebrities about their digital identity in the age of AI and deepfakes.

This judgment sets a precedent. It makes it clear that the image of any individual, especially a child, cannot be used on the internet to create sensationalism or to make money.
