Supreme Court Clears Stricter GRAP Rules for Delhi-NCR; Pollution Curbs to Trigger Earlier Across All Stages

Court advances all GRAP stages by one level, advises rescheduling school sports, and orders monthly pollution reviews as Delhi-NCR enters peak winter smog period.

New Delhi, November 21: The Supreme Court on Wednesday approved a sharper anti-pollution framework for Delhi-NCR, endorsing the Commission for Air Quality Management’s (CAQM) proposal to activate restrictions at earlier Air Quality Index (AQI) levels. The move is expected to prompt faster intervention as pollution levels rise through the winter.

A bench of Chief Justice BR Gavai and Justice K Vinod Ramachandran said proactive action was “essential and overdue,” and directed CAQM to ensure wider stakeholder consultations while enforcing the revised norms.

Key Changes: GRAP Stages Shifted Ahead

The revamped structure advances all stages of the Graded Response Action Plan by one level.

  • Measures earlier triggered at Stage 4 (AQI > 450) will now begin at Stage 3 (401–450).
  • Former Stage 3 protocols shift to Stage 2 (301–400).
  • Stage 2 interventions now move to Stage 1 (201–300).

Under Stage 3, CAQM has recommended—not mandated—a 50% staff attendance model for government, private and central offices across Delhi-NCR. Staggered office timings, earlier a Stage 3 intervention, will now be advised at Stage 2.

Court Flags Concern for Children’s Health

The court urged states to reschedule all school sporting events slated for November–December, citing high exposure risks. Following this, CAQM held discussions with education departments, SAI, and NCR governments, issuing directives to suspend all outdoor events in the two months.

“Children are the most vulnerable. Events must be organized during safer periods,” the bench said.

Continuous Monitoring, Monthly Reviews Ordered

Calling for year-round vigilance, the Supreme Court stressed that pollution action must not be “episodic or crisis-driven.” The court will take monthly updates from CAQM and the Environment Ministry. The next hearing is set for December 10.

Power Supply, Transport and Traffic Measures

NCR states were directed to ensure uninterrupted power supply to curb diesel generator use, ramp up CNG/electric bus fleets, and ease congestion at major intersections. Public advisories on air quality and preventive steps must be issued regularly.

Vehicle Restrictions and Crop Burning

The Centre asked for limited exemption for BS-III and older vehicles during Stage 3 curbs, pointing to previous Supreme Court orders on 15-year-old vehicles. Punjab and Haryana were instructed to strengthen enforcement against stubble burning, a major winter pollution contributor.

Relief for Construction Workers

Responding to complaints over stalled compensation payouts during construction bans, the Chief Justice said, “Workers dependent on restricted sectors cannot be left without income.” All NCR states have been ordered to clear pending dues for registered construction workers and file compliance affidavits.

CAQM will update GRAP documentation in line with the new directives.
